An Attempt to Reduce Israeli War Crimes in Gaza to Criminal Negligence

In an attempt to reduce Israeli war crimes in Gaza during December 2008 and January 2009 to Criminal negligence, an Israeli court in Nazareth accepted a law suit against the Israeli war criminals Olmert, Barak, and Ashkenazi.

This is an attempt to distract the world public opinion from holding the Israeli leaders responsible for the war crimes to mere criminal negligence, in which soldiers only will be responsible.

For justice to the souls of the victims, activists and human rights groups should not be bluffed or distracted and should continue their efforts to bring the Israeli war criminals to justice by trying them in international courts.

Samouni family files suit against Israel for “criminal negligence” during Gaza War

After losing 29 of its members to Israeli shells during the Gaza onslaught the Samouni family filed a suit in a Nazareth court Tuesday demanding 200 million US dollars in compensation.

On 4 January the Samouni home was targeted by an Israeli shell. Medical officials at Al-Shifa hospital also confirmed on 5 January that four children and three adults from the Samouni family were dead. The family gathered in a shelter that was attacked the following day.

Jalal Samouni, who managed to escape the building, told Ma'an's reporters at Al-Shifa Hospital the day his relatives were killed that more than 20 people were left inside the destroyed shelter, and that he feared many of them were killed. He said advancing Israeli troops told residents to stay in their homes. Then Israeli forces shelled the house.

The Zaytoun area family is suing Israeli Prime Minister Ehud Olmert, Defense Minister Ehud Barak and the Israel Defense Forces Chief of Staff Gabi Ashkenazi.

The suit calls the killing of innocent civilians who were seeking refuge in their home and a shelter "criminal negligence." The lawyer for the family said another 45 family members were injured in the attacks, mostly children between the ages of eight and 14.

"The soldiers who fired the shells did so in utter disregard of the innocent civilians present in the area of the fighting,” states the suit.


According to the Israeli daily Haaretz, the family’s Attorney Mohammed Fukra told reporters at the court "The Samouni family approached me last week and I imagine that in the coming weeks similar lawsuits will be filed."

Some of the other major attacks killing women, children and families were:

On 29 December five Ba'alousha sisters were killed when Israeli warplanes fired missiles in a residential area in Jabaliya. Their mother was able to remove three of her children from the house after she heard bombings in the area. A missile hit the house as she placed her youngest daughter in the arms of a neighbor. Those dead were four-year-old Jawaer Ba'alousha, her eight-year-old and two-year-old sisters Dina and Samar, as well as 14-year-old Ikram and 17-year-old Tahri.

On New Year’s Day Israeli forces bombed the home of Hamas leader Nizzar Rayan, killing his three wives and eleven of his children and seven other family members. Three Israeli missiles struck the four-story home in the densely populated Jabaliya Refugee Camp.

On 3 January an Israeli airstrike killed 14 Palestinians at a mosque in Beit Lahiya; dozens of others were injured when a missile struck the building during evening prayers.

On 4 January a mother and her four children were killed in an airstrike on the city of Rafah

On 5 January seven members of the Abu Aisha family were torn to pieces by shelling, and another five children were killed when Israeli warships shelled their home in the Al-Mashtal area in the north of Al-Shati Refugee Camp, on the shore west of Gaza City.

On 7 January two-year-old Amal, four-year-old Su'ad and six-year-old Samar were killed when an Israeli airstrike hit their home during an announced lull. The family home east of Jabaliya Refugee Camp was mostly destroyed.

On 16 January Israeli strikes in the Al-Shuja'iyah of eastern Gaza City killed ten in one home. A mother and her five children from the Al-Batran family were also killed in an Israeli airstrike on their home in the Al-Buraij refugee camp in the central Gaza Strip. Palestinian medical sources identified the dead as 30-year-old Manal, and her children 12-year-old Wala, 8-year-old Izzuddin, 10-year-old, Bilal, 11-year-old Islam, and seven-year-old Ihsan.

دعوى قضائية بقيمة 183 مليون شيقل لعائلة (ديب) من غزة

قدم المحامي محمد فقرا صباح امس الاحد للمحكمة المركزية في الناصرة دعوى مدنية قضائية بقيمة 183 مليون شيقل ضد ثلاثة اطراف من دولة اسرائيل وهم رئيس حكومة اسرائيل ايهود أولمرت ،

وزير الامن ايهود براك ورئيس هيئة اركان الجيش الاسرائيلي غابي اشكنازي وذلك نتيجة لاستشهاد 11 فردا من عائلة ذيب في مخيم جباليا بالاضافة الى خمسة مصابين منهم المقعد زياد ذيب الذي قطعت رجلاه ، وقد تم ذلك خلال حرب اسرائيل الاخيرة على قطاع غزة مع العلم ان افراد هذه العائلة تواجدوا في بيتهم ولم يشكلوا أي احتكاك وهم عائلة منعزلة ليس لها ذنب او طرف في تشكيل الخطر او امتلاك السلاح او غيره - كما ذكر المحامي محمد فقرا الموكل في قضية عائلة ذيب من مخيم جباليا ، لمراسلة موقع بانيت وصحيفة بانوراما.


المحامي محمد فقرا:"الصاروخ سقط من طيارة دون طيار والشهيدة امال كانت تخبز الخبز والزعتر"

وأضاف المحامي فقرا:" الاطراف الذين في الدعوى هم 12 شهيدا استشهدوا و5 مصابين اصيبوا خلال حملة الرصاص المسكوب التي فرضتها اسرائيل خلال الحرب الاخيرة على غزة ؛ والحدث المذكور جرى في يوم 2009-1-6 عندما تم قصف بيت عائلة ذيب من مخيم جباليا واثناء تواجد بعض افراده في فناء البيت سقط عليهم صاروخ من طيارة تبين انها دون طيار عن طريق الخبير العسكري من قبل الولايات المتحدة وبعد الفحص النهائي للمواد المستخدمة في الحرب ؛ والشهيدة امال مطر ذيب كانت تخبز الخبز والزعتر في ساحة البيت لحظة القصف وهي من الاحد عشر شهيدا من نفس البيت وبينهم ايضا امرأة في السابعة والستين من عمرها ونور طفلة لم تتجاوز الأربع سنوات ، قسم من المصابين باصابات بالغة عولجوا خارج البلاد مثل تركيا ومصر ومن بين المصابين شاب يدعى زياد ذيب ، مقعد نتيجة لقطع رجليه".


"النقطة المركزية هنا ان الأفراد تواجدوا في البيت وليس لهم أي احتكاك مع اسرائيل"

وتابع حديثه:"النقطة الاساسية والمركزية هنا ان الجريمة حدثت في البيت نفسه أي انه لم يكن قطعيا أي احتكاك او أي اشكال ، فأهل البيت امنون جدا أنهوا صلاة العصر وجلسوا في البيت للتحدث في امور الحياة وفجأة سقط الصاروخ ؛ وبما يتعلق بقيمة الدعوى والتي هي 183 مليون شيقل فبرغم قيمتها الا ان كل اموال العالم لا تسد مكان ظفر شهيد او مصاب ولكن بناء على القانون ان كل شخص او مؤسسة حكومية او غير حكومية تسببت في ضرر لأي شخص كان ، يحق للمتضرر ان يقدم دعوى قضائية مدنية".
واضاف:"السلطة الفلسطينية او أي طرف اخر يستطيعوا ان يتوجهوا الى المحكمة الدولية ويكون الامر جنائيا ولكن الامر هنا هو مدني أي تعويض المصابين ؛ واليوم تم تقديم الدعوى ضد دولة اسرائيل ليتم تسليمها الى النيابة العامة من اجل تقديم لائحة دفاع وبعدها ستتعين المحكمة".

"سبق ان ربحنا قضية مشابهة"

واختتم حديثه:"سبق ان حدث ذلك وربحنا قضية مشابهة لهذه القضية حيث انه قبل سنة ونصف تقريبا قوات الامن الاسرائيلية وصلت الى بيت معين في الضفة الغربية من اجل القبض على "مطلوب" ورد عليهم اخ المطلوب ومباشرة اطلقوا النار عليه واستشهد امام اولاده الستة ومحكمة الناصرة اصدرت قرارا بأن على دولة اسرائيل تعويض اهل المصاب وفعلا هذا ما حدث".
