Abbas and Haniyeh Issue Contradictory Decrees and Decisions

Deposed PM Haniyeh announces several motions related to the security services in the Gaza Strip

Gaza – Ma'an – 

Deposed Palestinian Prime Minister, Ismail Haniyeh, announced a number of motions related to the security services on Sunday.

The first decision orders the formation of a committee to devise a strategy for police operations in the coming period. The committee will comprise Brigadiers, Khadir Abbas, Tawfiq Jabir, and Hasan Ajrami.

The second motion orders the issuance promotions within the interior security forces, to include the military trainees which graduated on the 1st of January 2007.

The third decision cancelled the ninth Palestinian government's decision to appoint Rashid Abu Shibak as general director of interior security services and orders the appointment of a new director.

The fourth decision cancelled the appointment of Brigadier Kamal Al-Shaikh as general director of police.

The dismissed Prime Minister and also former interior minister circulated orders to all security forces, telling them to remain in their workplaces and undertake their duties as usual.

Haniyeh also decided to appoint a new director of the Fateh-affiliated preventive security service in the Gaza Strip, but did not disclose who was appointed.

Abbas outlaws Hamas-affiliated armed forces

Ramallah – Ma'an – 

Palestinian President Mahmoud Abbas on Sunday announced a presidential decree, which outlaws the Hamas-affiliated Executive Force and other militias, as a result of these groups executing an armed rebellion against the Palestinian legitimately elected leaders in the Gaza Strip.

The decree was based on a previous decree ratified three days ago, in which Abbas announced a state of emergency.

The decree comprises of two articles: one affirming that the Executive Force and other Hamas militias are outlawed; and the other demanding all official parties to implement the decree and publish it formally.

PLC speaker: emergency government is a "dangerous coup"

Gaza – Ma'an – 

Acting Palestinian Legislative Council (PLC) speaker Ahmad Bahar on Sunday described the Palestinian emergency government as a "coup" against the Palestinian law and constitution.

In a press conference held at the headquarters of the PLC in Gaza City, Bahar accused President Mahmoud Abbas of challenging the PLC and attempting to suspend it, along with the unity government. Bahar criticized Abbas's suspension of articles 65, 66 and 67 of the Palestinian law.

"The presidential decree announced by Abbas is the most dangerous violation of legislation in Palestine," said Bahar. He continued, "This violation could lead to the collapse of the whole legislative system in Palestine."

Bahar also said that the PLC cannot be dissolved during a state of emergency.

He said the refusal to negotiate with Hamas was "absurd" and "neglecting the fact that Hamas is an inseparable part of the Palestinian people."

Bahar issued a statement in response to declarations made by the speaker of the Fatah, Azzam Al Ahmad. He said "al Ahmad's claim that the Arab League and Arab foreign ministers have announced their antagonism to Hamas is creating a deep rift between Hamas and the Arab and Islamic world."

Abbas suspends PA law, designs laws to fit “illegitimate” emergency government

GAZA, (PIC)-- 

PA chief Mahmoud Abbas has issued another decree suspending a number of articles in the PA basic law that disallow him of pursuing his wrong steps in forming an emergency government without approval from the PLC.

According to the edict, articles 65, 66, and 67 of the law will be suspended, making the “illegitimate” emergency government free of confidence vote in the PLC, which many legal observers opined violates essential basis of the PA constitution.

The suspended article 65 of the PA basic law stipulates that the commissioned PA premier has only three weeks to set up his government in addition to two additional weeks as a grace period if he failed to finalize everything within the first three weeks, and if he still failed to carry out the mission within the specified period, he will be replaced.

However, article 66, which is also an essential article, obliges the new premier to call for a session for the PLC in order to get its confidence before he and his cabinet are authorized to assume duties.

Article 67 stipulates that the premier after obtaining the PLC confidence must be sworn-in before the PA chief.

By suspending those binding articles, Abbas transgressed the PA basic law and violated its basic articles in order to fit his own desire.

Meanwhile, the “illegitimate” emergency cabinet was indeed sworn-in by Abbas in Ramallah city Sunday without the PLC confidence, making it an “illegitimate” government based on the PA constitution.
